Rubbish Collection Bermondsey Service Terms and Conditions

These Terms and Conditions set out the basis on which we provide rubbish collection and related waste removal services to domestic and commercial customers. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation requesting and paying for the rubbish collection service.

We, us, our means the rubbish collection service operator providing waste removal services under these Terms and Conditions.

Services means any rubbish collection, waste clearance, bulky waste removal, recycling, or related work that we agree to carry out for the Customer.

Waste means any items, materials or rubbish presented by the Customer for collection that we agree to remove, subject to these Terms and Conditions and applicable waste regulations.

2. Scope of Services

We provide rubbish collection and related services in Bermondsey and surrounding areas. Our services may include one-off collections, regular scheduled collections, bulky waste removal, and recycling where available. The exact scope of the Services for each booking will be set out in the booking confirmation issued to the Customer.

We reserve the right to refuse to collect any Waste that is hazardous, prohibited by law, incorrectly described, not safely accessible, or exceeds the agreed volume or weight limits, or for any other reasonable safety or regulatory reason.

3. Booking Process

3.1 Requests for rubbish collection may be made by telephone, email, online form, or other booking method that we make available from time to time.

3.2 When placing a booking request, the Customer must provide accurate information, including but not limited to:

• Name and contact details
• Collection address and access details
• Type and approximate quantity of Waste to be collected
• Preferred collection date and time window

3.3 All bookings are subject to our acceptance and availability. A contract between the Customer and us is formed only when we confirm the booking in writing, by email, text message, or other written confirmation method.

3.4 We may request photographs or descriptions of the Waste in advance to assist with quoting, vehicle allocation, and compliance with waste regulations.

3.5 Any quotation given before we have inspected the Waste is an estimate only. We reserve the right to revise the price on site if the actual volume, type or weight of Waste differs from the information originally provided.

4. Access and Customer Responsibilities

4.1 The Customer is responsible for ensuring that our staff and vehicles have safe, reasonable and legal access to the collection location at the agreed time.

4.2 The Customer must ensure that:

• Waste is presented in a safe and accessible manner
• Any gates, doors or access routes are unlocked or attended
• Parking permissions or permits are arranged where necessary
• Any special access instructions are provided in advance

4.3 If we are unable to complete the collection due to lack of access, unsafe conditions, absence of the Customer when required, or incorrect address details, we may charge a call-out fee or treat the visit as a cancelled booking under the cancellation terms below.

5. Waste Types and Prohibited Items

5.1 We handle general household and commercial rubbish, furniture, appliances, garden waste, and other non-hazardous materials, subject to vehicle capacity and applicable regulations.

5.2 The Customer must clearly identify and declare any items that may be regulated, restricted or require special handling, including but not limited to electrical equipment, fridges and freezers, tyres, mattresses, and large volumes of building or construction waste.

5.3 We do not normally collect hazardous or specialist waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuels, gas bottles, explosives, pressurised containers, or radioactive materials. If such Waste is discovered, we may refuse collection and the Customer will remain responsible for arranging safe and lawful disposal.

5.4 If the Customer knowingly or negligently presents prohibited or hazardous items as part of a regular rubbish collection, the Customer will be responsible for any costs, penalties, or liabilities that arise as a result, including costs of safe handling, transport, and disposal.

6. Pricing and Quotations

6.1 Our prices are based on factors including the estimated or actual volume, weight, type of Waste, access conditions, labour time, and disposal or recycling charges.

6.2 Any price stated before the Waste is inspected is an estimate only and may be adjusted on site once we have confirmed the actual Waste to be removed. We will explain any adjustment before starting work and the Customer may choose to accept the revised price or decline the service. A reasonable call-out or assessment fee may still be payable if the Customer declines.

6.3 Unless otherwise stated, all prices are in pounds sterling and inclusive or exclusive of VAT as specified in the quotation or booking confirmation.

7. Payments

7.1 Payment terms will be confirmed at the time of booking. For most domestic customers, payment is due on completion of the collection, unless prepayment has been agreed. For business customers, different credit terms may be agreed in writing.

7.2 We accept payment by cash, card, bank transfer, or other methods that we may offer. Where card details are taken in advance, the Customer authorises us to charge the agreed amount on completion of the Service.

7.3 If payment is not made when due, we reserve the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs of debt recovery or legal action.

7.4 Title to any Waste passes to us only when it has been loaded onto our vehicle and full payment for the Service has been received or valid credit terms have been agreed.

8. Cancellations and Amendments

8.1 The Customer may cancel or reschedule a booking by giving us reasonable notice.

8.2 If the Customer cancels more than 24 hours before the agreed collection time, no cancellation fee will normally apply, unless specific costs have been incurred that cannot be recovered.

8.3 If the Customer cancels less than 24 hours before the agreed collection time, or fails to provide access when we attend, we may charge a cancellation or call-out fee to cover our reasonable costs, including travel and staff time.

8.4 Any request to amend the booking, such as a change of time, date, or significantly different Waste volume, is subject to availability and may result in a revised quotation.

8.5 We reserve the right to cancel or reschedule a booking if we are unable to attend due to vehicle breakdown, staff illness, extreme weather, safety concerns, or other events beyond our reasonable control. In such cases, we will offer an alternative time or a refund of any prepayments, but will not be liable for any indirect or consequential losses.

9. Performance of Services

9.1 We will carry out the rubbish collection with reasonable care and skill and in accordance with applicable laws and recognised industry practices.

9.2 Collection times are given as estimates or time windows and are not guaranteed. We will use reasonable efforts to attend within the agreed period but cannot accept liability for delays caused by traffic, access issues, operational problems, or circumstances beyond our control.

9.3 We are not obliged to dismantle or break up items to remove them, but may agree to do so at our discretion and subject to additional charges. Any dismantling carried out at the Customer’s request is done at the Customer’s risk, particularly in relation to fixtures, fittings, or integrated items.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10.2 Subject to the above, our total liability to the Customer for any loss or damage arising from or in connection with the Services, whether in contract, tort, negligence, breach of statutory duty or otherwise, will be limited to the total price paid or payable for the specific booking giving rise to the claim.

10.3 We will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the provision or non-provision of the Services.

10.4 The Customer is responsible for protecting any surfaces, flooring, or fixtures that may be at risk during removal of bulky items. While we will take reasonable care, we are not liable for minor cosmetic damage to walls, floors, or door frames that may be reasonably expected when removing large or awkward items, unless caused by our negligence.

10.5 The Customer must remove or protect any personal or valuable items that may be affected by the movement of Waste or furniture. We are not responsible for loss or damage to items that were not intended to be removed as Waste unless caused by our negligence.

11. Compliance with Waste Regulations

11.1 We operate in accordance with applicable UK waste management laws and regulations and will transport and dispose of Waste only at authorised facilities.

11.2 By engaging our rubbish collection service, the Customer confirms that they are entitled to transfer the Waste to us and that the Waste does not include items that are unlawful to possess or transfer.

11.3 Where required by law, we will issue appropriate documentation relating to the transfer and disposal of Waste, such as waste transfer notes, and will retain records in line with regulatory requirements.

11.4 The Customer agrees to cooperate with us in providing any information reasonably required to comply with waste regulations, including the nature and origin of the Waste.

12. Complaints

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as reasonably practicable, providing details of the issue and any supporting information.

12.2 We will investigate complaints in a fair and timely manner and, where appropriate, may offer a remedy such as a repeat visit, partial refund, or other solution, at our discretion and subject to the limitations set out in these Terms and Conditions.

13. Data Protection and Privacy

13.1 We will handle personal data provided by the Customer in connection with the Services in accordance with applicable data protection laws.

13.2 Personal data will be used primarily for managing bookings, delivering Services, processing payments, and handling queries or complaints. We may also retain data for record-keeping, regulatory compliance, and lawful business purposes.

14. Changes to These Terms

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings from the date on which the updated terms are published or otherwise notified to Customers.

14.2 The Terms and Conditions applicable to a particular booking are those in force at the time the booking is confirmed, unless a change is required by law or regulatory guidance, in which case the updated terms may apply retrospectively to the extent required.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be severed from the remaining provisions, which will continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the rubbish collection Services.

By confirming a booking or allowing us to commence the rubbish collection, the Customer acknowledges that they have read, understood and agree to these Terms and Conditions.
